Notice And TakeDown Policy
FandomBuzz respects the legitimate rights of Copyright Owners and is Compliant with the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (“DMCA”) . We are committed to comply with the applicable copyright and intellectual property legislation. Evidently, FandomBuzz has Adopted a Notice & Takedown mechanism, designed to enable intellectual property owners to report an infringing use of the Service, while preserving our users’ freedom to share.
If you have evidence, know, or have a good faith belief that your rights or the rights of a third party have been violated and you want us to delete, edit, or disable the material in question, you must provide us with all of the following information(as mentioned below) as a take down notice in PDF format sent to us via email to [email protected] .
The Details That should be mentioned in the TakeDown notice are as follows:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
- Identification of the material that is claimed to be infringed or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Us to locate the material;
- Information reasonably sufficient to permit Us to contact you, such as an address, telephone number, and if available, an electronic mail address at which you may be contacted;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
If you receive notification from us stating that a Takedown Notice was received regarding content or activity for which you are responsible, you may contend the Takedown Notice within seven days, in which case the content shall be re-uploaded and your contact details (which must be contained in the contention) be given to the Notice’s sender.
It is FandomBuzz Policy to Remove and Disable Access to identified Infringing material and notify the content provider that the content has been Removed.
A “Repeat Infringer” shall be defined as: A user which three Takedown Notices were received regarding content uploaded by him within a period of one year; or A user which a total of ten (10) Takedown Notices were received regarding content uploaded by him. FandomBuzz Reserves the Right to terminate the user’s account in the case of repeat infringements of copyrights.
